In simple words: if you give money to support WikiDeal, your gift goes to the Ynternet.org Foundation, the Swiss non-profit foundation that hosts and incubates the platform. This page explains what information would be collected when you donate, how it would be used and protected, and the core promise: your nonpublic personal information would never be sold, traded or rented. Nothing here is in force yet: it is a proposal, to be adopted.

Donor privacy policy

Welcome

Welcome to the proposed Donor Privacy Policy of the Ynternet.org Foundation ("the Foundation"), the non-profit foundation under Swiss law, headquartered in Geneva, which hosts and incubates the WikiDeal Markets and Portals (collectively, "the Platform"). This policy is intended to protect the privacy rights of the donors, funders and supporters of the Foundation. Donors care deeply about how their personal information is used and shared, and the Foundation values the privacy and security of its donors. This Donor Privacy Policy addresses the intended practices for collecting, using, maintaining, protecting, and disclosing donor information. Please carefully read this policy together with the proposed Terms of Use. The Foundation would never sell, trade, or rent your nonpublic personal information.

The funding of WikiDeal is described on the Economy and funding portal, including the pages on why fund WikiDeal and targeted donations.

Important information

By donating to the Foundation, you would understand that your donation entails the collection, transfer, processing, storage, disclosure, and use of your information in or to Switzerland, and possibly other locations that may have different data protection laws than your country, for the purposes stated in this policy. If you do not agree with the terms of the Donor Privacy Policy and the Terms of Use, please do not use the WikiDeal Funding Services (as defined below).

Definitions

"The Foundation", "us", "we", and "our" refer to the Ynternet.org Foundation.

"Donor Privacy Policy" and "policy" refer to this document.

"Personal Information" is information you provide us or information we would collect from or about you through the Funding Services that identifies or could be used to identify you. For more information, please see What information would be collected.

"WikiDeal Funding Services" are the funding pages and tools related to WikiDeal, such as the funding pages of the Economy portal, as well as funding-related emails from the Foundation and funding-related banners on the Platform.

What this policy covers

This Donor Privacy Policy covers the collection, transfer, processing, storage, disclosure, and use of information collected from you during the process of making a donation to the Foundation for WikiDeal and through your interactions with the WikiDeal Funding Services ("Donor Information"). This policy does not cover the collection, transfer, processing, storage, disclosure, or use of your information related to your use of the Platform itself, such as creating or signing contracts on a Market. For more information regarding the intended privacy practices in that respect, please review the main Privacy policy (first draft, under review). This policy also does not cover donations made to, or other interactions you may have with, independent partner organizations or user groups. For more information about the privacy practices of those organizations, please review their respective privacy policies.

What information would be collected

As a result of your interaction with the funding pages, making a donation, participating in a donor survey or providing feedback related to donating, or otherwise using the WikiDeal Funding Services, the Foundation could collect certain Personal Information, such as your name, contact details (such as address, phone number, email address), financial information (such as bank account number), device details (such as IP address, web browser user-agent information) and information you choose to share about your interests.

The Foundation could also collect or automatically receive some other information, such as:

  • the web page that referred you to the funding pages;
  • the amount you donated;
  • which pages you request and visit;
  • the date and time of each request you make to the funding pages;
  • comments and suggestions from you;
  • correspondence between you and the Foundation; and
  • any other information you provide to us.

Donor Information would be kept confidential, meaning that it would not be shared outside of the Foundation except as permitted by this policy or in de-identified form.

The source policy that inspired this proposal also allows the collection of donor information from publicly available and commercially available sources. This practice is not proposed for WikiDeal: only information you provide, or that your visit generates directly, would be collected.

Cookies and other tracking technologies

As you interact with the WikiDeal Funding Services, automatic data collection and other locally stored data technologies such as JavaScript, cookies, and local storage could be used to collect certain information about your device.

Cookies and other locally stored data would be used to enhance your donation experience, to create a safer online environment and to gain a better understanding of donor preferences and interactions with the Funding Services. In general, cookies and other locally stored data would be used to:

  • help the Funding Services function and deliver relevant content to you;
  • provide you with a personalized experience by storing your preferences so that they can be used the next time you visit the Funding Services;
  • analyze the performance of donation processes so that they can be understood and improved; and
  • analyze interactions with funding emails so the donation process can be refined and improved.

Limiting data collection by cookies and other tracking technologies

The collection of this data is intended to help improve your donation experience; however, you may remove or disable some or all cookies through your browser settings. While not a comprehensive list, you can limit the use of cookies and other locally stored data on your device by:

  • removing or disabling specific locally stored data in your browser's settings;
  • using a browser that can block third-party cookies; and
  • installing a plugin to block locally stored data, if available.

Donations via the WikiDeal Funding Services are intended to remain possible without cookies and other locally stored data; please note, however, that the removal or disabling of these features may affect your navigation of the funding pages and the personalization of your experience.

Do Not Track

The Foundation intends to protect the information collected from all donors and not to share it with third parties, except in the specific circumstances described in the Sharing Donor Information section of this policy. The precise handling of a web browser's Do Not Track signal is an open point of this proposal: it is intended to be aligned with the main Privacy policy, which proposes to follow the strictest practices of the reference organizations it studies.

How Donor Information would be used

Donor Information collected from you would be used for general administrative purposes and to operate the funding processes. This includes:

  • administering the WikiDeal Funding Services;
  • updating you about upcoming funding milestones and other Foundation activities related to WikiDeal;
  • thanking you for your donation; and
  • setting language preferences.

These activities would be carried out to manage the relationship with you and for the legitimate interests of the Foundation in managing the WikiDeal Funding Services.

Donor Information collected from you would also be used to comply with various obligations relating to recordkeeping and reporting. This includes:

  • distributing donation receipts;
  • maintaining internal records;
  • complying with applicable tax requirements;
  • reporting to applicable government agencies as required by applicable law; and
  • communicating substantive changes to this policy and related policies.

These activities would be carried out to comply with legal obligations and for the legitimate interests of the Foundation in managing its donation processes.

Donor Information collected from you would also be used to improve and update the WikiDeal Funding Services. This includes:

  • customizing content (for more detail, please see below);
  • understanding donors' interest in WikiDeal;
  • improving the funding processes and efforts;
  • conducting internal analyses, such as research and analytics;
  • providing greater security; and
  • conducting survey and metric reports.

Where processing is based on your consent, you would be able to withdraw your consent at any time consistent with applicable law.

Providing customized services

To enhance your experience with the WikiDeal Funding Services, your general geographic location could be used to customize the currency, content, and language of funding banners. What funding banners you see or messages you receive could also be customized, depending on your interactions with past banners or messages.

Accessing your Donor Information

The Foundation intends to accurately process and maintain Donor Information. If you would like to request to access, correct, update, suppress, restrict or delete the Personal Information held about you, object to the processing of such Personal Information, or if you would like to request to receive an electronic copy of your Personal Information for purposes of transmitting it to another organization (to the extent this right to data portability is provided to you by applicable law), please let us know by contacting us at info@wikideal.net. While reasonable efforts would be made to comply with your request consistent with applicable law, there are certain situations where a request may not be granted (such as when your identity cannot be adequately verified, when information must be retained by law, or when it is not technologically possible to change or delete information at that time).

All emails sent relating to the WikiDeal Funding Services (with the exception of receipts or administrative notices) are intended to include an easy option to unsubscribe. If you would like to change your communication preferences, you (or an authorized representative) can let us know by contacting us at info@wikideal.net at any time, or by clicking the unsubscribe link in an email you receive from us.

Sharing Donor Information

Donors may wish to remain anonymous, and the Foundation intends to honor such requests and preserve your anonymity. However, in limited circumstances, Donor Information could be used and shared in the situations and under the conditions described below. Your nonpublic Personal Information would never be sold, traded, or rented.

With your permission. With your consent, your information could be shared for a particular purpose. For example, donors could be given the option to have their name publicly associated with their donation.

In anonymized form. Anonymized Donor Information could be published or shared. For example, anonymized data sets could be shared to show donation trends.

Comments and suggestions. Comments or suggestions that donors provide could be published, including in materials presenting WikiDeal, in anonymous form. Publication of such information with donor attribution would only happen with your written (which may be electronic) consent.

Online payment processors. In order to facilitate online donations, the Foundation would partner with payment processors. When you make a donation through the WikiDeal Funding Services, whether by credit card, debit card, or other methods of online payment, you transmit your payment data directly to the payment processor. Contractual agreements and other mechanisms would be used to help ensure that these processors maintain the confidentiality of your information. However, please be aware that the Foundation is not responsible for the privacy practices of these processors; please consult the privacy policies of the applicable payment processor for more information about its practices.

Other service providers. Third-party service providers or contractors could assist with the organization and facilitation of the WikiDeal Funding Services, or help run the funding operations or improve your experience with them. These providers or contractors could be given access to your personal or non-personal information as needed to perform their services or to use their tools and services. A list of these service providers, with links to their privacy policies, is intended to be published when such providers are engaged. While the privacy or security of services provided by third-party providers cannot be guaranteed, contractual agreements and other mechanisms would be used to help ensure that these service providers or contractors treat your information consistent with, and in a manner no less protective than, the principles of this policy.

For legal reasons. On certain rare occasions, consistent with legitimate interests and/or to comply with legal obligations, your Personal Information could be accessed, preserved, or disclosed to public authorities or other persons if it is reasonably believed to be necessary to satisfy a valid and legally enforceable court order, law or regulation, or other judicial or administrative order under applicable law. If a particular request for disclosure of a donor's information is believed to be legally invalid or an abuse of the legal system, and the affected donor does not intend to oppose the disclosure themselves, the Foundation would do its best to fight the request. The Foundation intends to notify you via email at least ten (10) calendar days, when possible, before your personal information is disclosed in response to a legal demand. However, such notice may only be possible if the Foundation is not legally restrained from contacting you, there is no credible threat to bodily harm that is created or increased by notifying you of the request, and you have provided an email address or other current contact information.

Nothing in this policy is intended to limit any legal objections or defenses you may have to a third party's request (whether it be civil, criminal, or governmental) to disclose your information. We recommend seeking the advice of legal counsel immediately if such a request is made involving you.

If the organization is transferred. In the extremely unlikely event that the responsibility for hosting WikiDeal changes, or the Foundation goes through a reorganization (such as a merger, consolidation, or acquisition), your Personal Information could be transferred. Notice would be provided via the Platform and a public announcement, at least thirty (30) calendar days before any Personal Information is transferred or becomes subject to a different donor privacy policy.

To protect you, ourselves, or others. If necessary, your personal information could be used or shared to: enforce or investigate potential violations of the Terms of Use, this Donor Privacy Policy, or any Foundation or community-based policies; investigate and defend the Foundation against legal threats or actions; prevent imminent and serious bodily harm or death to a person; protect the organization, its employees, contractors, users, or the public; or detect, prevent, or otherwise assess and address potential spam, malware, fraud, abuse, unlawful activity, and security or technical concerns.

How your Donor Information would be protected

To ensure a high level of security and confidentiality, the Foundation intends to employ a variety of physical, administrative, and technical measures, policies, and procedures to help protect your personal and financial information from unauthorized access, use, alteration, disclosure, or destruction. However, you should be aware that no storage system or data transmission is 100% secure. Therefore, it cannot be guaranteed that security protocols will never be compromised.

How long your Donor Information would be kept

Once Personal Information is received from you, it would be kept for the shortest possible interval that is consistent with the maintenance, understanding, and improvement of the donation process, and the obligations of the Foundation under applicable law. Separate retention rules for donor information are intended to complement the general Data retention guidelines.

Partner organizations and user groups

Independent partner organizations and user groups could conduct their own funding efforts. While some of them could give a portion of the funds they raise to the Foundation, the Foundation would not be involved in processing donations made to these organizations. They may have different privacy policies and practices depending on local legal requirements and other considerations. This policy does not cover donations made to them.

Changes to this Donor Privacy Policy

From time to time, it may be necessary to modify this policy in order to accurately reflect actual data collection and disclosure practices. The Foundation would reserve the right to do so, and would provide notice of such changes in a reasonable manner and time. We encourage you to review the most up-to-date version of this Donor Privacy Policy periodically.

Your continued use of the WikiDeal Funding Services after any effective date of a subsequent version of this policy would constitute acceptance of that version of the Donor Privacy Policy on your part.

The Foundation is subject to the Swiss Federal Act on Data Protection (FADP). Depending on your jurisdiction, you may have the right to lodge a complaint with a supervisory authority competent for your country or region, such as the Swiss Federal Data Protection and Information Commissioner (FDPIC). Whether additional representative arrangements are needed for donors located in the European Economic Area or the United Kingdom is a point to be reviewed at adoption.
